Homeowners responsibilities

​Palomar Hills Community Association, Inc. remains dedicated to maintaining and improving common areas and amenities. The association is responsible for performing routine repairs and maintenance. The association may hire independent contractors for major projects or repairs. All projects are funded by the annual budget, which is developed and approved by the board of directors and neighborhood presidents.
​Homes with "curb appeal" help the neighborhood look its best. There are many explanations for the demand for homes in our neighborhood-good schools, proximity to the airport, the natural beauty of the neighborhood, attractive homes and yards, and other aesthetic features. The Palomar Hills Community Association Inc. is dedicated to making sure property values continue to increase. Through the Palomar Press, Palomar Today, emails messages, and letters, residents are reminded of maintenance responsibilities to help give their property a neat, clean appearance. The association manager is charged with enforcing the standards and restrictions by notifying homeowners when certain aspects of a property need attention and following up to make sure the needed work has been done.
Lawn care
​Lawn and bedding areas should be maintained regularly by mowing, edging, trimming shrubs, and mulching. Lawns should be free of weeds. After mowing, grass clippings should be sweep or blown off sidewalks and curbs.
Street trees
Neighborhood restrictions and the Urban County Code of Ordinances require street trees to have seven feet of clearance over sidewalks and 12 feet over streets. As trees grow, it is important for their health and appearance to keep them limbed up. Some trees need minor limbing-up. Trees that have gone without proper maintenance for years may require the services of a professional tree company. While there is some expense involved in hiring a tree company, proper pruning will result in a stronger, healthier, more attractive tree.

In addition to enhancing a tree's natural beauty and allowing for better views of home and landscape, limbing-up makes it safe for walkers, joggers, bicyclers, children riding school buses, and motorists passing by on sidewalks and streets.

In general, the association will ask homeowners to remove and replace street trees that are missing, damaged, dying, or disfigured. Homeowners without sidewalks may not be aware that they, too, have street trees that are located on a "planting easement". As defined by the LFUCG Code of Ordinances: The tree planting easement shall mean a planting area with a minimum width of five (5) feet located immediately adjacent and parallel to the street right-of-way.

Please note, the minimum size for a replacement tree is 2 1/2 inches in diameter. Newly planted trees require extra care. Deep watering is critical, regardless of the season in which they are planted. Even older trees need deep watering to stay healthy. "Gator Bags" are a convenient way to water trees.

Leaf Removal
Homeowners are responsible for raking and removing leaves from their property. Palomar Hills does not provide leaf removal program, and the neighborhood does not receive Lexington- Fayette Urban County Government leaf removal services.

Residents should never rake leaves to the curb or street in anticipation of pick-up by city workers. Allowing leaves to accumulate in the gutter or storm drains creates an eyesore and clogs storm drains, resulting in flooding. Walkers and
joggers may slip on leaves left on sidewalks.
Mailbox & Downlighting
Mailboxes must be maintained using paint color, decals, and lettering approved by the neighborhood association. Please see below for information on refurbishing mailboxes. 

Downlighting 
Mailbox downlighting adds a very subtle yet pleasing touch to the streetscape in the evenings. If the light is not functioning, contact the office and the association will install a light set ($5.00 cost to homeowners) as a free service to the residents. If there is more involved, the association will advise homeowners about any repairs that are necessary. Restoring mailbox downlighting is not mandatory. 
 
Mailbox
Following are step-by-step instructions on how to paint and/or repair the mailbox yourself.  Remember that all mailboxes must conform to the neighborhood-wide standard regarding style of mailbox, color of mailbox, flag and horse head, decal font and style.
(Only Oil-base paint has been used on Palomar’s mailboxes. Because oil-based may take on a faded, chalky appearance after three years, there is new option for residents to use, latex (water-based) paint. Preparations to paint with oil-base and latex will vary slightly. This will be indicated in the instructions.)
*Proper preparation of mailboxes is necessary to achieve the best and longest lasting results.  
 
Materials Needed:
  ►metal primer paint :  Use Rust-Oleum spray automotive primer that is acceptable for application of enamel or latex paint.
   > Metal sandpaper, light & heavy grit
   > New or clean paint brushes
  ►gold paint : spray or brush on gold metallic
  ►clear coat sealant spray: optional, but enables gold on horse’s head to last longer
  ►bright red paint : 1/2 pint is sufficient
  ►mailbox green : buy from Superior Paint on Regency Road, 276-5264.  Ask for “Palomar Green Oil Base” or Palomar Green Latex”, by Benjamin Moore; (Note that Olde Bridge Estates uses glossy black only)
  ►decals : Decals may be purchased at the following locations; Instant Signs, 246-1185, located at  1011 South Broadway.  (This is at the corner of South Broadway and Red Mile Road); Sign A Rama, 272-7886, 4013 Nicholasville Rd. Your mailbox must include the house number and flourish; your name is optional.  The decals are custom-made upon ordering, therefore, you will need to call first and place your order.  Payment is required when you place your order.  Credit cards may be used to reserve your order until time of pick-up-there is a one-day turn-around.  The font style must be Times New Roman; all numeric characters must be 11/4” high; all alpha characters must be upper case and 1” high; if using the word “The” in front of your surname then the “T” must be upper case and the “he” must be lower case; lastly, the flourish must be 12” in length,
    ►trash bag : 30 gallon, or larger, polyethylene trash bag to prevent overspray
    ►masking tape
    ►light bulb : new automotive, #1157, 12-volt light bulb packaged as back-up light for trailer
    ►cut and bend coat hanger : to facilitate holding the flag while painting it
    ►new mailbox : (if needed) The new all-steel replacement mailbox is available through  David Powers at (859) 223-5259 or may be purchased from Lowes.  It is an “Ironside Rural Mailbox” with a magnetic door available in two colors, black (model MB801B-04) and taupe(model MB801T-04).   If you plan to purchase the replacement mailbox and install it yourself, please remember that the mailbox must meet all of the neighborhood requirements regarding paint color of box, flag and horse head, font style and size, etc.   Don’t forget that all mailboxes must contain the respective house number and fleur de lis design; family name is optional.
Equipment Needed:
    ►safety goggles
    ►wire brush, or electric drill plus chuck mounted rotary wire brush plus long 3-prong
     > metal drill bits
     > hand pliers
     > hammer
     > heat gun (for application of decals in colder weather)
     > GROUNDED extension cord to plug into GFI receptacle
     ►cabinet-blade screwdriver for removing red flag
     ►needle-nose pliers for reshaping/reinstalling ring in horse’s nose
     ►small level
 
Methods:
              Step 1:  Remove the two screws holding the flag onto the mailbox and thoroughly wire-brush and sand to a smooth surface the entire exterior surface of the mailbox, including the horse’s head and the post.  Use the wire brush and heavy grit sandpaper to remove ALL traces of the previous decals, both on the mailbox and the apron underneath.  DON’T try to paint around the decals (this will be more time and effort for you and the end result is a poor appearance). This is the most important component of mailbox refurbishing because if the old rust, loose paint and faded decals are not removed the new paint will not adhere for long and you will be wasting your time. This is also the proper time to repair the horse’s nose ring, install/replace the 12-volt light bulb, repair the hinges of the mailbox door (they should be riveted because nuts and bolts work loose, look terrible and may rust), tighten the loose handle on the mailbox door, and straighten minor bending on the mailbox apron (severe damage probably means your mailbox needs replacing).
              Step 2: (for oil-base) Prime the entire mailbox, horse’s head, post and mailbox apron with the spray primer.  Follow the instructions regarding drying and re-coating
        * Step 2: (for latex paint) Clean the entire mailbox, horse’s head, post and mailbox apron with TSP Cleaner. (TSP cleaner must be used because latex is going over oil-base paint. TSP may be purchased at hardware or paint store.) Areas where rust has been removed, prime with rust inhibited primer.
              Step 3:  Carefully cut a 2” diameter hole in the bottom of the trash bag, and then slip the bag over the horse’s head.  Use the masking tape to hold the bag securely over the mailbox, apron and post.  This will protect all but the horse’s head from getting unwanted gold spray paint, which may fall or drift from the wind onto the surfaces that will be green.
              Step 4:  Spray paint the horse’s head gold metallic, and when dry, apply the clear coat sealant to the gold.  While waiting for the gold to dry, wire brush (lightly) the red flag that was detached from the mailbox earlier.  DO NOT use wire brush the flag while on the mailbox at this time or dust and dirt will stick to the wet paint on the horse’s head.  Next, insert a cut and bend coat hanger into the hole of the flag (to facilitate holding it) and spray primer onto all areas of the flag.  Allow to dry and apply two thin coats of the red paint and then allow to dry for about 2-3 days.
              Step 5:  Remove the trash bag and apply the green paint to the mailbox, apron and post. * (Two coats recommended when using latex paint.)
              Step 6:  When the green paint is thoroughly dry (allow 1 full week of dry weather), apply the decals carefully (use the masking tape and a level to create a temporary horizontal line to help align the street number, and optional names).  Then, reattach the red flag and holder.  Check for proper flag operation before tightening the screws.

sidewalks
​Sidewalks must be kept in good repair. Homeowners may be held liable for injuries resulting form breaks, cracks, and uneven sections in their sidewalks. Please note that pursuant to the master Document and the City Code of Ordinances, "…the owner of real estate adjoining any sidewalk is responsible for replacing defective sections of the sidewalk using material similar to that used in 
the existing construction…" [Section 17 - 147].

Replacement runs about $4.50 a square foot; one section of sidewalk typically measures about 16 square feet. You may qualify for reimbursement from the Lexington-Fayette Urban County Government (LFUCG) of up to fifty percent (50%) of the cost of these repairs, up to $2.25 per square foot. All repairs must conform to LFUCG standards.

To be eligible for reimbursement, LFUCG first must confirm the sidewalk needs to be replaced or repaired. Call the Division of Code Enforcement (258-3270) to start this process or to report other sidewalks in disrepair. Once the city has cited the property, the homeowner has 120 days to make repairs. City inspectors mark areas with a pink "X" that are in need of repair or replacement.

  1. Maximum size of dish is 18".
  2. Dishes shall be bolted to wall surfaces away from view of front of house and adjoining streets.
  3. Sides of houses are fine if toward the rear.
  4. Deck mounted dishes would be least favorable.
  5. Mounted below the roofline.
fences
 POLICY FOR FENCES
(August 9, 1993)

​A. All proposed fences or privacy walls must be approved by the Modification Committee prior to installation.

B. Fencing of the front yard areas will not be permitted.

C. No chain link or unfinished aluminum fencing will be permitted.

D. No fences will extend beyond the building line thirty (30) feet back from the interior side of the sidewalk (for corner lots this includes the side yard also.)

E. All fences will be minimum of three (3) feet and maximum of five (5) feet in height; unless prior approval is obtained.

F. Wood fences: prefer the boards run vertical to the ground.

G. Fence cannot extend beyond the rear corner of your house toward the front.

H. On wood fences, boards must have spaces between each board. Spaces must be greater than one-half the width of the boards. No stockade type fencing will be permitted.

I. Fences surrounding concrete patios are considered patio enclosure. Those in yard areas are fences.

ADDENDA: 6/29/98
J. Fences at the boundary line of Palomar Hills shall be of uniform construction. Style is to be "Shadow Box" 1 x 6 vertical with a maximum height of six (6) feet. (This is the style of the fence along Man O' War near Lyon Drive, at the rear of the Villas). Perimeter lots, other than those bordering or visible from Man O' War Drive, shall be consistent with existing fences on adjacent properties provided they conform to the fence guidelines.

K. Support posts of all fences must be internal to the property.

L. Post and rail landscape fences, made of stone or wood, no higher than 2 ½'

patio enclosures
A. All proposed Patio Enclosures must be approved by the Modification Committee  prior to installation.

B. Enclosure of front yard areas will not be permitted.

C. No chain link or unfinished aluminum fencing will-be permitted.

D. No enclosures shall extend beyond the building line (30'TYP) at front or side yards including corner lots.

E. All enclosures shall be 6 (six) feet max. in height.

F. On wood enclosures, it is preferable that boards run vertical to the ground.

G. Enclosure shall not extend beyond the rear corner of your house toward the front.

H. On wood enclosures, boards must have spaces between each board. Spaces must be greater than one-half the width of the boards.

I. Brick may be used if it matches adjacent walls.

J. Patio enclosures shall extend only to the limits of the patio and not include any lawn area.
additions
POLICY FOR ADDITIONS TO TOWNHOMES AND HOMES

A. Exterior wall treatments shall be maintained by owner. Brick or siding on addition to match adjacent wall finish. Wall treatments shall continue to grade and in the case of a deck enclosure where supports are needed, these supports need to match the adjacent wall finish.

B. Roof pitch shall be similar to existing roof lines and shingles shall match existing. Min. roof pitch to be 4:12.

C. Exterior windows, doors and cornice shall match existing in style and detail.

D. Skylights will be permitted provided they are curb-mounted type.

E. Building permit must be obtained prior to commencement of work.

These standards shall apply to sundecks converted to enclosed rooms.
screened in porches
​(1) Support post shall be min. of 6 x 6 and continue to grade.

(2) Lattice work may be used under a deck

(3) Items B thru E (located in Patio Enclosures), apply to screened-in porches, patios, or decks.
pet owners
Pet owners are responsible for the actions of their pets. Please demonstrate respect and courtesy by adhering to the following rules:

Barking that is audible to other property owners is considered a nuisance to neighbors and a violation of city ordinance and Palomar Hills deed restrictions. Do not leave your dog outside or on a porch or deck unattended during the day or at night. Some dogs bark so loudly that even when confined inside the residence, the barking can be heard by neighbors. If your dog is barking, please address the issue immediately.

Show respect for your neighbors and their property when walking your dog. 
The Master Documents states, "Dogs which are household pets shall at all times whenever outside a unit be confined on a leash held by a responsible person." Keeping your dog on a leash is a matter of courtesy, safety, and compliance with LFUCG ordinance and Palomar Hills restrictions.

Please do not allow your dog to dig or play in the mulch around street trees and planting beds belonging to others. While long leashes are great, they also allow dogs to run onto neighbor's properties and damage or destroy work the homeowners have done to maintain and improve their lawns and landscaping. Parents, set the proper example by teaching your children the responsibilities involved in walking the family pet.

Clean up after your pet
Responsible pet owners and good neighbors carry plastic bags when walking their dogs. Please use the bag to pick up your pet's droppings on property belonging to others and in all common areas, including the park, the section behind the Villas fence, and along Lyon Drive.

Cat owners
While there are no leash laws for cats, owners should be aware of what their cat may be getting into when allowed to freely prowl the neighborhood.
brick pull-off areas
​Homeowners are responsible for maintaining the decorative concrete pull-off parking areas adjacent to their properties. This entails keeping the area free of debris and weeds; and trimming shrubs in nearby plantings beds. Some plantings in beds next to pull-off areas have grown too large and are blocking the line of sight for oncoming traffic and the sidewalk for pedestrians.
trash containers
​Trash containers and recycling bins must be stored completely out of sight except on the evening prior to and the day of trash collection. They may be store outside only if totally screened from view. Most residents store these items in their garage. 

The applicable neighborhood restriction states trash containers "…shall be located or screened so as to be concealed from view of neighboring Units, streets, and property located adjacent to the unit. Garbage cans or recycling bins shall not be left at the curb after the designated day for pick-up. All rubbish, trash, and garbage shall be regularly removed from the Unit and shall not be allowed to accumulate thereon."

The LFUCG Code of Ordinance states, "Herbies should be rolled to the curb no earlier than 7 p.m. on the evening before scheduled collection and no later than 5 a.m. on collection days. They must be removed from the curb by 7 p.m. on collection days…."
